2024 GICLI Annual Meeting

Corporate legal departments face a similar phenomenon: achieving more with finite resources. Doing more with less is that much more challenging when considering the escalating risk and complexity teams encounter when handling government investigations and civil litigation.

To reinforce its mission of furthering legal tech education, the Government Investigations & Civil Litigation Institute (GICLI) will host its annual meeting in Fort Lauderdale this fall. CFIUS Compliance Monitorships: What You Need to Know

Compliance monitorships of controls required by the Committee on Foreign Investments in the United States (CFIUS) for national security reasons have grown in importance as CFIUS has become more active in recent years. A monitorship provides the CFIUS Monitoring Agencies (CMAs) with the day-to-day oversight necessary to show that the covered transaction’s National Security Agreement (NSA) obligations will not jeopardize US national security generally by compromising critical infrastructure industries, critical technology, IP, PII, or real estate. This panel will discuss best practices for CFIUS compliance monitorships, including when monitors are used, how monitors are selected, how monitorships work in practice, and reconciling the goals and perspectives of regulators, monitors, and corporations.

Algorithmic Pricing & Antitrust

Pricing algorithms developed using artificial intelligence raise new competition and consumer protection questions. Highlights to be covered include: how commercially available pricing algorithms reduce consumer transparency and facilitate collusion and information sharing; whether the current antitrust legal framework is equipped to face modern challenges like digital markets and pricing algorithms; views on early DOJ and FTC’s enforcement and announcements; and how enforcers and regulators can ensure that AI promotes innovation without creating entry barriers or strengthening monopolies.
