Cyber Lawfare

We live in the ‘Age of Eternal Breach,’ where cyberattacks and data privacy risks permeate our lives. International and domestic cyber law regimes are out of date. International cyber law is frustrated when nation-states obfuscate norms of behavior. Add to this thorny problem that a “cyberattack” is not a legal term of art. Instead, the issue is whether a malicious cyber event is a use of force that may or may not rise to the level of an armed attack. Many people supported Brad Smith – President of Microsoft – when he called for a “Digital Geneva Convention” to protect civilian cyberinfrastructure and data from harm caused by nation-states and their proxies. But is a Digital Geneva Convention possible under international law? And what about the mosaic of domestic cyber laws? Should domestic laws be updated to reflect certain realities of cyberwarfare?
