The New Cybersecurity Governance Requirements: The Role of Legal Departments in Achieving Compliance

The Cybersecurity Regulation of the New York Department of Financial Services contains prescriptive requirements for the cybersecurity programs of banks and insurance companies and has led to the adoption of similar requirements by regulatory agencies in other industries. The recently proposed amendments to the Cybersecurity Regulation expand the governance practices and certifications required of senior executives and boards of directors. The proposed amendments not only increase compliance risks for banks and insurance companies but also outline for companies in other industries what their regulatory agencies are considering. This panel will describe in detail the proposed amendments to the Cybersecurity Regulation and explain what companies and legal departments in all industries should be doing to achieve compliance with enhanced cybersecurity regulations in the coming years.
